Is this the end of the prank call?

With the recent BBC controversy over the prank calls made by Radio 2 presenters Russell Brand and Jonathan Ross to actor Andrew Sachs, its got me thinking about how this could impact other BBC Radio Shows like Scott Mills show. Scott has been making prank calls on people for years and its a big part of his regular drivetime show. But with the recent controversy its got me thinking if Management will request changes to be made to the shows format as a way to not upset any viewers who may still be still sensitive over the recent controversy. Calling the likes of Barry Chuckle pretending to be a stalker is in my opinion light hearted comedy that shouldn't be taken too seriously, but I do wonder how many people will now take offense to these prank calls and will Scott or the Producers want to risk offending people.

Scott's calls aren't really that controversial where Russel can get a bit out of hand. He made a prank call to a charity once didn't he and got into trouble with them.

I believe (and might be wrong) that Scott's team ask the receivers permission before broadcasting the call.

As far as I'm aware, Russell Brand's team played the calls to Andrew Sachs before they were aired, so I'm sure he would have been able to get them pulled.

It wouldn't surprise me if prank calls were pulled- look at the blanket ban on competitions on the back of the 7 Song Shuffle scandal- another total overreaction by the Beeb. You didn't see ITV and C4 putting a total ban on phone-ins etc on the back of their fakery problems.

They played them back to him but he was near a main road and he didn't hear them that well. But he didn't give them consent to air the calls at the time, they just went ahead.

And let's not forget that what Russel did was actually against the law ;)

I don't think so- it doesn't span enough time to be a harassment, it's not defamatory as it is true that he slept with Georgina Baillie and he didn't say anything threatening to Mr Sachs. I don't think upsetting people is against the law.

Prank calls have been on the decline on the show recently anyway which as I have said before is something that really disappoints me. I don't know whether this is because there are more restrictions on this sort of material or because they have just decided to change the format but i can't see it helping bringing back prank calls.

Sorry to be a nerd (although Paula will be proud), and this doesn't reflect my opinion on the subject but under the Telecommunications Act 1984:

"A person who— (a)

sends, by means of a public telecommunication system, a message or other matter that is grossly offensive or of an indecent, obscene or menacing character; or

(B)

sends by those means, for the purpose of causing annoyance, inconvenience or needless anxiety to another, a message that he knows to be false or persistently makes use for that purpose of a public telecommunication system,

shall be guilty of an offence and liable on summary conviction to<!--STARTCOM--> [F1 <!--STOPCOM-->imprisonment for a term not exceeding six months or a fine not exceeding level 5 on the standard scale or both<!--STARTCOMEND-->]<!--STOPCOMEND-->."

Surely the media are more guilty than Ross and Brand

Thank you Grace, Section 43 Of the Telecommunications Act is exactly the one I was thinking of :D It definitely goes under improper use of telecommunication system. If you push it really hard, he could be sued for breach of privacy although I don't think the distress caused would be enough.

I would say that in terms of S.43(a) Russell and Jonathon only made a private phone call, which the BBC then broadcast, so their actions would not fall under this section. The BBC and producers of Russell's show may be guilty under this section, but certainly not Jonathan.

EDIT: Although I see that phone calls would also count, so am just gonna contradict myself.

    • The BBC commissioning brief mentions it is a 'mid morning show' for Radio 1 Dance https://www.bbc.co.uk/commissioning/radio/documents/comm_brief_r1_dance_morning_show.pdf
    • Nothing to apologise about, I was just intrigued on how DS and UM react
    • I would be pretty confident that if they keep avoiding using James Cusack on that slot over the next few weeks, then it will probably be him that gets the show permanently!
    • That’s two names who probably won’t be doing that slot permanently then.
    • Moyles spent most of the 52hr sgow calling him that lol
    • I stand guilty as charged as the DS poster.... It was I Okay, so yes Connor has good energy and does the show well, I take it back, however, my last experience of him he spent every other link saying "It's Connor Coates in for the ledge that is Charlie Hedges" and then he started saying "Clem Douglas" - again after critisising that I see she is styled as that sometimes The point I was trying to make was, yes we know it's Charlies show, we know she is a ledge, and we know she is not here today, no need to keep reminding us Regards R1 dance, I suspect Arielle is pointed at the drivetime slot to go against Mistajam unless we know it is breakfast that will be live ? Apologies to Connor and anyone offended by my comments, was just going on my past experience of Mr Coates, who seems to be a very competnt presenter
    • I know we have discussed this before, but can someone shed some light hoping @Lily Georgia can help Since the Wogan House closure, and 1-330 from Manchester, studio 82A (Mills) has been used by Scott's R2 show, in fact i note that him and Grandad Nelson are from there now days The question I have is with 1-330 coming from London again soon, who is getting a new studio? will Scott move to one of the newer ones down the corridor or will he remain in 82A and M&M get a new studio They cannot use 82D as that is used for drive, and currenlty 82A is in use by Scott from 2-4pm In the old days it used to be 82A for Greg, Scott, Annie and 82D Adele, RMC, Drive, Jack I note that Jack is in a brand new studio so maybe M&M will come from that one as well, maybe the same one as Vine uses?
    • Maia Beth is doing Friday Early Breakfast on 7th & 14th June.
    • Joel Mitchell is in for Nat on Sunday 9th June.
    • Ore Olukoga is on 13.00-16.00 on Friday 31st May and Friday 7th June.  Nikita Kanda is doing Saturday 1st and Sunday 2nd June.
    • Very pleased for producer Amy - it's no coincidence many of the best shows in recent years have had her working on them. You can tell her & Helena are a great production duo and that the whole Matt & Mollie team are a really close-knit unit in general. Some lovely speeches by both Matt & Mollie too to end the show on Sunday.
    • Echo what most have said here. Connor has great energy which is important for that sort of slot and the shame for him is that the dance line-up is so strong that there's no obvious 'in' for him to get a regular slot -Danny, Sarah, Pete Tong, Arielle, Charlie Hedges, Jerry and Charlie Tee are all great in their slots. A live show on Radio 1 Dance really feels the obvious way to get a proper foot in the door at Radio 1. Although to be fair to the DS critic I think it was just the one poster and can very much hear Connor in my head saying 'in for the legend that is Charlie Hedges'.
    • James Cusack is in for Jack on Friday 14th June, doing the chart while Jack is at Download.
    • I remember hearing Amy first on Scotts show and she was great on that, the daft quiz questions always made me smile. It's really nice to see the hard work has paid off for them all.
